SA...from: Sentinel's Cops and Courts<br /><br />May 15, 2009<br /><br />SANTA CRUZ<br /><br />found at: http://www.santacruzsentinel.com/ci_12383944?source=most_viewed<br /><br />Man challenges trespass ticket<br /><br />Homeless advocate and freelance journalist Robert Norse was in court Friday to challenge a trespassing ticket he received in front of the downtown Santa Cruz Metro transit station in November.<br /><br />A security guard asked a Santa Cruz police officer to cite Norse after he allegedly refused to comply with requests to leave the property. At issue is whether the officer had cause to banish Norse from the area and if he was ticketed under the correct city ordinance. City code includes a statute for trespassing at a business as well as a more -specific clause for Metro property.<br /><br />Norse's attorney argued that his client was exercising his First Amendment rights by interviewing people and making audio recordings of those interactions, and that the officer acted outside of his authority because he didn't like that Norse was recording their conversation.<br /><br />The case is being heard in a court trial in front of Judge Ariadne Symons.
